Contract

The transporter will do everything possible to adhere to the shipping and delivery dates agreed to in this agreement. However, due to travel delays associated with weather, unexpected cancellations, unexpected vehicle maintenance, road construction and conditions, etc, it does become necessary on a rare occasion to adjust our shipping and delivery dates.

 

The shipper agrees to:

He or she will make the necessary arrangements for the following and to be responsible for all the costs associated with each:

1.    Original Health Certificate (Required)

2.    Brand Inspection (If required)

3.    Original Negative Coggins (EIA) Test (Required)

4.    Halter that is in good shape and the appropriate size

5.    1-2 bales of hay per horse (If you choose for us to provide the hay we will do so at NO additional cost).  We prefer and recommend that you provide the hay that your horse has been used to being fed as it will be better not to switch feeds during the start of a trip.  We do provide an Alfalfa/Grass Mix about an 80/20 mix.

6.    Blankets, stable sheet, or fly sheets if needed and applicable for the trip.


Equine Interstate Transport, Inc. does carry our own Mortality/Liability Insurance and your horse is covered up to $14,000.  You will find that this is higher than the industry standard.  Our Policy is Indemnified through The Hartford.

A deposit of at least 50% of the shipping fee must be received in advance to reserve your spot.  Cash, money orders, certified checks, cashier’s checks, business or personal checks, debit cards and credit cards, are all accepted.  The balance must be paid in full upon loading. Your horse will not be unloaded until the balance is paid.

If the shipper makes payment arrangements different than those stated above, then that verbal arrangement will be considered legal and binding for both parties.


Additional Costs:

·         The rate that has been quoted is for the delivery and care of your horse(s) from the pick up/shipping address to the delivery/drop off address stated in this contract.

·         Different size stalls, if not in the original quote, are available for a surcharge.

·         We don't mind a few Tack items being transported with your horse.  However, additional Tack charges will range from $25 and up based on the amount of tack, unless previous arrangements have been made with the Transporter prior to the scheduled trip.

·         A change of pick-up or delivery location from that quoted may be subject to an additional charge after review.

·         If the transporter has to wait at the pick-up or delivery location there will be a charge at the rate of $50.00 per hour after the first 30 minutes of waiting.

·         Roads with difficult access, if not previous brought to the attention of the Transporter will be subject to an additional charge. This charge will be based on the difficulty of the road and the amount of time lost. These types of roads, and long dirt, or unpaved roads need to be disclosed to the Transporter ahead of time.

·         A horse that is difficult or reluctant to load or unload will be charged a fee of $50 per hour after the first 30 minutes of attempted loading or unloading.

·         Any damage to the trailer or equipment caused by your horse, or layover locations if applicable, will be billed to the Shipper along with two written estimates for the necessary repairs.

·         A fee of $100.00 will be applied for any returned checks.


Cancellations:

·         More than 7 days prior to the TRANSPORTERS departure for the scheduled trip- all monies will be returned, except for a $75.00 cancellation fee.

·         More than 72 hours of the TRANSPORTERS scheduled departure for the scheduled trip – there will be a 25% cancellation fee.

·         Within 24 hours of the scheduled departure 50% of the total shipping fee.

·         Our office has 30 days to refund the deposit in case of cancellation.

·         Furthermore, transporter reserves the right to cancel (as a last resort only) the trip due to hazardous weather, mechanical difficulties, or extenuating circumstances. 

·         The Transporter agrees:

·         Transporter will use due diligence and the utmost responsibility and safety to transport, feed and care for the aforementioned horse(s).

·         In the event the horse(s) require the services of a veterinarian, the Transporter will immediately notify the Shipper. In the event the Shipper cannot be reached, the Transporter is hereby authorized, as agent for the Shipper to call the first available licensed Veterinarian of his/her choice. All fees charged by said Veterinarian shall be the sole and exclusive responsibility of the Shipper, with no liability whatsoever on the transporter for such fees.


Release:

·         The Shipper voluntarily releases and forever discharges the Transporter and it's agent from any and all liabilities, claims, demands, actions or rights of actions, which are related to, rise out of, or are in any way connected with the transport of the aforementioned horse(s). 

·         Shipper hereby holds harmless Equine Interstate Transport Incorporated for any liability that would incur for property damage or bodily injury to any horse(s) and/or owners/passengers while loading, transporting, unloading or handling the aforementioned horse.
